SUMMARY:Hiring Contract Labor: The Great Debate-Small Business Council 4-12-11
DESCRIPTION:The Great Debate: Employee vs. Independent Contractor\n\n \n\nAre you misclassified? Will you be one of the 6000 companies audited by the IRS? When the gavel falls do you have a leg to stand on? In this brief session\, you will learn the difference and if you are in compliance. \n\n\n\nThe GAO\, the investigative arm of Congress\, has accused the U.S. Department of Labor and the Internal Revenue Service of not enforcing the laws regarding who is an employee and who is a bona fide contractor. Congress has appropriated additional enforcement funds to both agencies.\n\n\n\nThe USDOL has hired additional investigators. Congress has ordered both agencies to vigorously enforce the Tax Code and the Fair Labor Standards Act to prevent misclassification of employees. Misclassification can result in assessment of back taxes and penalties\, overtime pay\, minimum wage and child labor violations for workers "employed" by employees who were misclassified as contractors.\n\n\n\nThis informative session is fgcilitated by Mark Knuckles from Mark Knuckles Associates\, Inc.\n\n\n\nMark left the U.S. Department of Labor in 1986 to start his own consulting firm\, Mark Knuckles Associates\, Inc. (MKAI). MKAI is recognized as an FLSA & Part 525 Commensurate Wage Authority. Mark is frequently asked to speak for private\, public & non-profit sector groups. Mark speaks and conducts training regularly for state associations and employer associations. Since 1989\, he has published the The Knuckles Report\, a monthly newsletter on human resource management & workplace regulation compliance. MKAI has more than 400 clients in 35 states.
